Synopsis:

The contaminated land planning condition was attached to the decision notice as the proposed erection of a dwelling is considered to be a sensitive development (contamination is assumed unless proven otherwise).

The site formed part of the garden of the adjacent dwelling as well as part of an orchard. A number of potential sources of contamination (adjacent electricity sub-station, worked coal seams etc.) were identified and discounted as part of the risk assessment.

Given the risks arising from use of the site as an orchard could not discounted, as part of the walkover survey the site soils were sampled and demonstrated the site was not impacted by elevated levels of contamination.

The report was accepted by the local authority and the condition discharged.
