Synopsis:

Due to the sensitive nature of the development and that the site was adjoining a site (a former garage developed to apartments) determined a ‘contaminated land’ under Part 2A of the Environmental Protection Act a contaminated land planning condition was attached to the decision for the proposed development.

Whilst the desk study report concluded that the risk from the adjacent site was low, an intrusive investigation was required to demonstrate this was the case.

The Phase II intrusive investigation was undertaken in March 2014 and the report demonstrated that there were no risks ot human health and the conditions were discharged.
